Spousal Maintenance

Divorce Lawyer in Lakewood, Colorado

Experienced Representation in Spousal Maintenance Matters

If you are contemplating divorce or are already a party to a divorce proceeding, you may be uncertain how spousal support or maintenance is determined. Will the court automatically grant spousal support? If not, what do you have to show to be entitled to maintenance? Will spousal support be permanent?

At the law office of Steven A. Hirschey, P.C., I have handled all matters related to spousal maintenance/support for men and women throughout Denver and Jefferson County for over 32 years. I have an extensive knowledge of the law, the process, and your rights and responsibilities in spousal support matters. I know how to effectively negotiate a spousal maintenance agreement, but will also aggressively advocate for you in court, if necessary to protect your interests.

I offer a free initial consultation to all clients. Send us an e-mail or call our office to schedule an appointment.

Lakewood Colorado Family Law Attorney Steven HirscheyOur Spousal Maintenance Practice

I represent men or women in spousal support disputes, looking first to determine whether support is warranted in your case. Spousal maintenance is not automatic in Colorado, but will only be awarded on a case-by-case basis, after the court has reviewed a number of relevant factors, including:

  • The length of the marriage.
  • The age and health (mental and physical) of both parties.
  • The lifestyle enjoyed during the marriage.
  • The respective earning capacity of each party.
  • How the marital property was allocated.

I will work closely with you to make certain the court has a clear and accurate picture of your situation, so that you have the best chance for a fair outcome. If support is deemed necessary, I will act as your advocate to help determine the amount, frequency and duration of payments. I handle situations involving:

  • Bridge or temporary spousal support—support granted for a limited period of time, designed to help the recipient meet financial obligations while developing the skills and training to be gainfully employed.
  • Long-term spousal maintenance—for situations where it will be difficult or impossible for the recipient to find employment that will allow continuation of the lifestyle found in the marriage.
